Definition of Low Risk Work
‘Work of a minor nature’ is usually but not always low risk. ‘Work of a minor nature’ may still be hazardous and must be carried out in full compliance with all applicable provisions of the work health and safety legislation.

What is work of a minor nature?
Testing, maintenance, or repair ‘work of a minor nature’ is work that generally:
- requires minimal control measures to manage risks
- requires little or no pre-start preparation
- ·of the work area, and
- is small scale and often of short duration.
- If the work can be safely carried out with minimal preparation of the work area, then it could be considered ‘work of a minor nature’. Factors that may relate to minimal preparation are:
- small scale work that doesn’t impact the existing design of the building or structure
- work that can be undertaken by workers with minimal supervision
- work that can be completed using hand tools and/or only requires light-duty material e.g., material that can be used without mechanical aids and does not need a designated storage area, and
- work that has minimal effect on the public, e.g., roads and footpaths are not affected.
If more detailed preparation is needed, or is considered high-risk - the work is regarded as high-risk construction work and will require the contractor to register as a High-Risk contractor and follow that process
Before starting work, ensure the building will not be affected by the work. If you believe the building may be affected, then it is not ‘work of a minor nature’. If necessary, obtain advice about the building or structure’s stability from the asset management team.
EXAMPLES OF CONSTRUCTION WORK OF A MINOR NATURE
‘Work of a minor nature’ can be hazardous, and the risk should be assessed to determine suitable controls and ensure compliance with work health and safety legislation. Further information on assessing and managing risks can be found in the Code of Practice: How to manage work health and safety risks and other hazard specific codes of practice, for example the Code of Practice: Managing the risks of falls at workplaces.
Work of a minor nature can include the following:
- inspecting a building’s fire equipment
- inspecting a building’s lifts but not maintaining or repairing the lifts regardless of how minor
- inspecting and servicing of, or replacing parts or repairing damage to:
- an air-conditioning system but not installing or replacing the entire system
- individual solar panels but not installing or replacing the entire solar panel system
- pressure piping, including mechanical sleeving, repairing insulation and applying protective coating, but not welding, cutting or replacing sections of pipe
- sprinklers but not installing or replacing the entire sprinkler system
- an irrigation system but not installing or replacing the entire system
- a water pump
- a prefabricated rainwater tank
- a smoke detector
- an alarm once de-energised but not the entire alarm system
- remote-controlled windows, doors, gates and turntables once de-energised
- an intercom system
- a home entertainment system
- a satellite dish or antenna
- a computer networks
- a light globe, tube or diffuser
- •non-structural joinery such as kitchen cabinets, wardrobes, plasterboard panels, windows, doors, architraves
- floorboards, floor joists, floor bearers on the ground floor but not an entire room or deck
- furnishings, such as carpets, curtains, blinds and non-timber floors
- floor and wall tiles, and grouting but not an entire room or deck
- skirting boards, ceilings and cornices but not in an entire room
- footpaths and steps but not the entire structure
- individual roof tiles but not an entire section
- gutters but not the whole guttering system
- a fence but not replacing an entire fence or gates
- a toilet, cistern and taps
- removing unleaded paint, patching, sanding or painting walls
- landscaping e.g., pruning plants, cutting grass, digging holes but not building a retaining wall or laying bricks or operating a machine like an excavator.

Defintion of Marketing Contractor
Documentation required

- Risk assessment developed, reviewed, and signed by competent persons
- Complete Inductions upload required licences
- Supervisor/worker completes JHA (Job Hazard Analysis) on site
Contractors will be deemed as “Marketing Contractors” when engaged by Mirvac Marketing, Activation and Experience Teams. Marketing Contractors will be required to provide a risk assessment on the risks associated with the works, the risk assessment should be conducted by a “Competent Person” and someone who is familiar with all work steps required to set up and complete the works safely. The risk assessment must be reviewed with the relevant Mirvac asset team involved with the work and then submitted to the Mirvac HSE team for final review. The Marketing Contractor must provide a method to communicate to all workers involved in the work the hazards identified and controls required.
Mirvac can provide assistance with Risk Assessments for Marketing Contractors carrying out Basic Low Risk Activities
Please note if the Risk Assessment identifies High Risk work a SWMS (SAFE WORK METHOD STATEMENT) for the High-Risk task will be required to be developed by a “Competent Person,” submitted, and accepted by Mirvac prior to carrying out the works. Definition of Non Construction Work
If your work is not carried out in connection with a construction project and does not include any high-risk work as per the “High Risk Work” definition, then it is defined as non-Construction work and does not require you to submit any Safe Work Method Statements for your activities
Documentation required:
- Provide Insurance Certification
- HSEMS (Health and Safety Management System) certification / manual (if applicable)
- Safe Operating Procedures (if applicable)
- Complete Inductions and upload required licences
- JHA (Job Hazard Analysis) (optional for repetitive works e.g., security patrols, office cleaning)
Examples of Non-Construction Work:
Office Cleaning Organisations – Not where it involves Rope Access, use of Plant e.g., EWPs (Elevated Work Platform) ride on floor scrubbers, high pressure washers
Provision of Security Services – Not when conducted on a live construction project
Where the contract is NOT in connection with a construction project the following examples are not considered to be construction work –
- Building Inspections, including fire equipment and systems, or lifts, or air conditioning systems, irrigation systems, water pumps, security systems and alarms, electrical meters, intercom systems, satellite dish or antennas (where access is ground level), computers systems and IT support,
- Replacement of light globes, tubes, and diffusers,
- Provision and placing of furniture
- Maintenance and upkeep of internal planting

Definition of Principal Contractor / Head Contractor
Documentation Required –
- Current Insurance Certification
- Current HSEMS Certification (or evidence of compliance)
- Project Specific WHS (Work Health and Safety) Management Plan
- Project Specific Risk Register/Assessment
Principal/Head contractors will be engaged as per contractual and legislative requirements.
Principal/Head contractors will be required to have a Health and Safety Management System (HSEMS) that is certificated to, or is at least in line with AS/NZ 45001:2018
Principal/Head contractors who have a certified HSEMS will be required to provide current certification, those that do not have a certified system will be required to provide evidence that they are meeting the requirements of AS/NZ 45001:2018
All Principal/Head Contractor engaged by Mirvac will be subject to an HSE evaluation to assess their HSE competence and to meet the minimum HSE standard that Mirvac require for Principal/Head Contractors.
After contract award Principal/Head contractors will be required to provide a WHS Management Plan and a Risk Register or Project Risk Assessment that are specific to the project engaged for. These documents are to be developed, reviewed, and signed by the site teams involved in the projects and must be reviewed and approved by Mirvac prior to commencing works on site.
In addition, all Principal/Head Contractor engaged by Mirvac will be subject to and “HSE Implementation Audit,” at a point in the project, the audit will be based on the contractors HSEMS as presented to Mirvac at tender stage. the contractors must provide Mirvac with monthly HSE reports.
All Principal/Head Contractor engaged on a Mirvac asset must allow access to the Mirvac asset/HSE teams to allow spot check inspections and monitoring by the Mirvac asset teams
TENANT ENGAGED SERVICE PROVIDERS
Principal Contractor / Head Contractor (Tenant to ensure the contractor can provide the following)

- WHS Management Plan
- HSEMS Certification / Evidence of HSEMS (Mandatory)
- Site manager complete Inductions

Any contractor wishing to register for this personnel type must request a registration invite from the Mirvac asset team and have their work task assessed by the Mirvac HSE team, approval will only be given to contractor who are deemed to present a very low risk from their works.
Non-physical work definition will be applicable to contractors who are engaged to carry out works which -
- Hazards are assessed as Low Risk to the contractor or others in the vicinity
- Has little to no impact on the day to day running of the Mirvac asset
- Does not involve the use of any hazardous equipment or materials
- Does not require any specific licence
- Does not involve any hazardous manual handling
